Ninth Circuit affirms $1.3 million judgment obtained by firm against national environmental contractor

February 19, 2020 — The Ninth Circuit affirmed a $1.3 million judgment that Luminate Law obtained against a national environmental services company in the federal district court in Hawaii. The appellate court issued a brief memorandum opinion affirming the judgment two weeks after holding oral argument on the appeal. The case pitted a Hawaii subcontractor in a major remediation project against the general contractor. The subcontractor alleged that the general contractor diverted work under its contract to other vendors. The federal district court issued a decision in favor of the subcontractor after a bench trial. Elijah Yip, a partner with Luminate Law, was lead counsel for the subcontractor.
